Albuquerque, NM (KKOB) — The New Mexico Supreme Court has ruled the state can be sued by someone who is harmed because of negligence when a prison inmate is released by mistake. The unanimous opinion comes in the case of Kathleen Paquin of Albuquerque who was killed by Christopher Blattner in 2012 after he was released 3 years early. The court ruled the errant release fell under the same laws that govern negligent building, facilities or equipment operations
