THE FATAL SHOOTING OF AN UBER PASSENGER IN ALBUQUERQUE LAST MONTH HAS RESULTED IN A WRONGFUL DEATH LAWSUIT. THE ALBUQUERQUE JOURNAL REPORTS THE ESTATE OF THE MAN WHO WAS SHOT, JAMES PORTER, IS SUING UBER AND THE DRIVER, CLAYTON BENEDICT.
THE LAWSUIT ALLEGES THAT BENEDICT’S ACTIONS WERE INTENTIONAL, RECKLESS, AND MALICIOUS. BENEDICT HAS NOT BEEN CRIMINALLY CHARGED IN THE CASE. THE INCIDENT HAPPENED ON ST. PATRICKS DAY ON THE SIDE OF SOUTHBOUND I-25 NEAR MONTANO.
