Albuquerque, NM (KKOB) — A man accused of raping a child had his case dismissed in Santa Fe because no prosecutor showed up for his hearing. 33-year-old Frankie Marquez was facing numerous counts including raping a child under the age of 13. His defense attorney asked the case be dismissed because no one from the DA’s office joined in the virtual hearing, and Judge Mary Marlow Sommer agreed. The District Attorney blames what they called a “mis-calendaring.”
