Albuquerque, NM (KKOB) — Wednesday the New Mexico Court of Appeals upheld the conviction of Fabian Gonzales. He’s serving a 37.5-year sentence for dismembering the ten-year-old Victoria Marten’s body in an effort to get rid of it, in 2016. Gonzales appealed six of his seven counts, arguing there was not enough evidence to convict him. He also claimed there were problems with the jury instructions, and that convicting him on six counts was double jeopardy. The appellate court didn’t see it that way and affirmed the conviction.
